  • Dual Capacity - employers are being sued in a capacity other than as an employer.
Dual Capacity means that the employer can wear two hats at the same time. For example, ABC Machinery Corp is a manufacturer of paper cutting machine. John Smith, an employee of ABC, is injured at work. After receiving the Workers Compensation Benefits for his medical expense and loss in wages, John can sue ABC for negligence in designing the machine. In this case, ABC is wearing the manufacturer hat. John's wife can sue ABC based on the fact that after the injury, John is so emotional distressed that he stays away from his spouse. John's wife claim is based the Care and Loss of Services Claim.
